Dmytro Donenko, Senior Associate of ENGARDE Attorneys at Law, has delivered a report at the meeting of the Ukrainian Bar Association’s (UBA) Committee on ADR (Alternative Dispute Resolution). The meeting took place on Tuesday, 4 October 2016. It was devoted to the arbitrability of disputes.
Dmytro dealt with the issue of arbitrability of disputes in the context of criminal law aspects. In the report Dmytro, inter alia, analyzed a complex theoretical issue of arbitration clause effectiveness in case of nullity of the underlying contract. Besides, he covered arbitrability of disputes containing aspects of criminal law.
Mr Donenko also looked into the practical aspects of this kind of disputes, such as compensation of damage, payments, debts and restitution due to nullity of an illegal contract.
Dmytro’s report caused a vivid discussion among the members of the UBA’s Committee on ADR. Not surprisingly so, as the information was important both for theoretical and for practical reasons.
