Iryna Shevchuk takes part in the International Forum on the case-law of the European Court of Human Rights

Iryna Shevchuk, attorney at ENGARDE Attorneys at Law, took part in the IX International Forum on the case-law of the European Court of Human Rights.

The forum — well known and highly regarded among practitioners — was co-organised by the OSCE Project Co-ordinator in Ukraine under the project “Support to Professional Training of Judges”, the Council of Europe project “Further Support for the Execution by Ukraine of Judgments in the Context of Article 6 of the European Convention on Human Rights”, the Faculty of Law of Ivan Franko National University of Lviv, the Supreme Court and the National School of Judges of Ukraine.

Because of COVID-19 restrictions the event was held on 9 and 10 December 2020 by video conference, which allowed the number of active participants to be expanded to 130.

This year speakers and participants focused on the implementation of European fair-trial standards in Council of Europe member states, effective co-operation with the European Court of Human Rights, gender equality and access to justice in the Court’s case-law, the duty to investigate human trafficking under Article 4 of the European Convention on Human Rights, and the interplay between the Convention and the Charter of Fundamental Rights of the European Union.

In the opening session, ECtHR Vice-President Ksenija Turković addressed the principle of solidarity in the Court’s case-law. In Iryna Shevchuk’s view, the most valuable contributions from a practical standpoint were those of Supreme Court Judge Dmytro Hudyma on aspects of the application of Article 6 of the Convention in the practice of the Grand Chamber of the Supreme Court; ECtHR Judge in respect of Azerbaijan Latif Huseynov on abuse of the right of individual application; and Ganna Yudkivska, ECtHR Judge in respect of Ukraine, on the Court’s current case-law concerning hate speech.
